Vodochodsky vs. State of Texas

This opinion reversed the conviction of Kenneth Vodochodsky. The basis of Vodochodsky's indictment was Texas' law of "Parties", which is found in the Texas Penal Code, Sections 7.01 & 7.02. The indictment alleged that Vodochodsky was a party to the offense when he "solicited, encouraged, directed, aided or attempted to aid" his roommate, in the commission of a capital offense on October 12, 1999. The Court's opinion held that the evidence presented during the seven week trial was "factually insufficient" to support Vodochodsky's conviction. It was hotly contested throughout the trial whether Vodochodsky was even present during the commission of the offense.
The case was returned to the trial court, where it was settled in the spring of 2006.
